Terms of Service and Privacy Policy

1. Acceptance of Terms

By accessing or using the Work Besties website and services (”Service”, “Website”, “we”, “us”, or “our”) provided by Mindspire LLC (”Company”), you agree to be bound by these Terms of Service and Privacy Policy (”Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Work Besties is a subscription-based career coaching and job tracking platform that provides:

  • Unlimited conversations and video calls with dedicated career coaches (”besties”) to help guide, motivate, and support you throughout your job search, career transitions, promotions, and career pivots

  • AI-assisted coaching sessions, in which you converse with an AI coach to define a career goal, assess your competencies, and work through open-ended coaching conversations. These sessions are processed by Anthropic on our behalf (see Section 8.2)

  • Tools for setting and tracking career goals and the competencies that support them

Depending on the plan you choose, your subscription may include coaching from a human bestie, AI-assisted coaching, or both. The features available on each plan are described at signup.

3. Eligibility and Account Requirements

3.1 Age Requirement

You must be at least 18 years old to use this Extension. By using the Extension, you represent and warrant that you are at least 18 years of age. We do not knowingly collect personal information from individuals under the age of 18. If you believe we have collected information from a child under 18, please contact us immediately, and we will delete that information.

3.2 Account Creation

  • You must create an account through our authentication service to use the Service

  • Account creation requires authentication via LinkedIn OAuth

  • You are responsible for maintaining the confidentiality of your account credentials

  • You agree to provide accurate, current, and complete information during registration

  • You are responsible for all activities that occur under your account

3.3 LinkedIn Account Requirement

  • The Service requires an active LinkedIn account for authentication

  • You must comply with LinkedIn’s Terms of Service when using this Service

  • We are not affiliated with, endorsed by, or sponsored by LinkedIn

  • Any issues with your LinkedIn account are your responsibility

4. Subscription and Payment

4.1 Subscription Plans

  • The Service is available through monthly subscription plans, which differ in whether they include coaching from a human bestie, AI-assisted coaching, or both

  • Some plans are limited to a fixed number of subscribers and may be unavailable when full

  • Subscription fees are displayed at signup and are subject to change with 30 days’ notice

  • The Service is only available through a paid subscription; there are no free features

4.2 Payment Processing

  • All payments are processed securely through Stripe

  • We do not store your payment card information

  • Payment information is handled by Stripe and subject to Stripe’s Terms of Service and Privacy Policy: https://stripe.com/privacy

  • By subscribing, you authorize us to charge your payment method on a recurring monthly basis

4.3 Billing

  • We charge your payment method monthly on the same date you initially subscribed

  • If payment fails, we may suspend your account until payment is received

  • You are responsible for keeping your payment information up to date

4.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings

  • Cancellation takes effect at the end of your current billing period

  • You will retain access to the Service until your current billing period ends

  • No refunds are provided for cancellations, as you retain access until the end of your paid period

  • Refunds are not available for unused portions of your subscription

4.5 Subscription Changes

  • We reserve the right to modify subscription plans, features, or pricing

  • Material changes to pricing will be communicated with 30 days’ notice

  • Continued use of the Service after price changes constitutes acceptance

5. Information We Collect

5.1 Information You Provide

Account Information:

  • Name, email address, and profile picture (obtained through LinkedIn OAuth)

  • LinkedIn profile URL

  • Context and information you share during conversations with your coach

Coaching Information:

  • The career goal you define, along with your own ratings of it

  • The competencies you identify, and where you place them on the competency matrix

  • The messages you send during AI coaching sessions

Authentication Data:

  • LinkedIn OAuth tokens (stored securely on our servers)

  • Session tokens for maintaining your login state

5.2 Information Automatically Collected

Technical Information:

We do not collect analytics, usage statistics, telemetry, device information, or IP-based tracking. We do not record which pages you visit or how long you spend on the Service. We use a single cookie to keep you signed in, described in Section 6.3.

AI Session Records:

  • Which type of coaching session you started and when it began

  • Technical details of the session, such as its length and size, which we use to monitor cost and quality

  • A short summary label describing the theme of the conversation

Meeting and Scheduling Data:

  • Meeting schedules and calendar information (via Cal.com integration)

  • Meeting history and attendance records

  • Notes associated with a booking

5.3 Information from Third-Party Services

From LinkedIn:

  • Your name and email address

  • Your LinkedIn profile picture

  • Your LinkedIn profile URL

From Cal.com:

  • Meeting schedules and availability

  • Meeting attendance and participation data

From Stripe:

  • Subscription status, and the identifiers Stripe uses for your customer record and subscription

  • We do not receive or store your payment card details or billing address; those remain with Stripe

6. How We Use Your Information

We use the information we collect to:

6.1 Provide and Improve the Service

  • Authenticate your account and provide access to the Service

  • Connect you with your assigned career coach

  • Enable scheduling and management of meetings with your coach

  • Provide customer support and respond to your inquiries

  • Improve and optimize the Service

Coach Data Access: Coaches can only see information that you explicitly disclose to them during conversations or meetings. Coaches do not have access to your account data, preferences, or other information unless you choose to share it with them.

6.2 Communication

  • Send you a summary of your results after you complete a competency assessment

  • Send you occasional reminder emails when it has been a while since your last coaching session or meeting. You can unsubscribe from these at any time using the link in the email footer, without affecting your account. Assessment summaries are part of the Service itself and are not subject to unsubscribe

  • Respond to your support requests

  • Send important updates about the Service or changes to our policies

  • Communicate about your subscription and billing

6.3 Cookies and Tracking Technologies

  • We use a single cookie, which holds your session token and keeps you signed in. It is set as httpOnly, meaning it cannot be read by scripts running in your browser

  • We do not use advertising, analytics, or cross-site tracking cookies, and we do not track you across other websites

  • You can control cookies through your browser settings

  • Disabling this cookie will prevent you from signing in

6.4 Legal and Security

  • Comply with legal obligations

  • Enforce our Terms of Service

  • Detect and prevent fraud, abuse, or security issues

  • Protect our rights and the rights of our users

7. Data Storage and Processing

7.1 Server Storage

The following data is stored on our servers:

  • User account information (name, email, profile picture from LinkedIn)

  • Meeting schedules, history, and any notes attached to a booking

  • Your career goal, including your ratings of it, and its status

  • Your competencies and their placement on the competency matrix

  • A record of each AI coaching session: its type, technical details of its length and size, and a short theme label

  • A record of which emails we have sent you and which you have unsubscribed from

  • Authentication tokens (LinkedIn OAuth tokens, stored securely)

  • Subscription status and the Stripe identifiers that link your account to your subscription

We do not store the contents of your AI coaching conversations. The messages themselves are processed to generate a response and are not retained on our servers once the session ends. What remains is the session record described above and anything the session explicitly saved, such as a goal or a competency.

Location: Our servers are located in the United States. Your information may be transferred to and processed in the United States, which may have different data protection laws from those in your country.

7.2 Data Transmission

  • All data transmitted between your browser and our servers is encrypted using HTTPS/TLS

  • Authentication tokens are transmitted securely and stored using industry-standard practices

  • We do not transmit your LinkedIn password or access your LinkedIn account directly

7.3 Data Retention

  • We retain your information indefinitely unless you request deletion

  • There is currently no automatic data deletion or expiration

  • The data we retain is described in Section 7.1. The contents of your AI coaching conversations are not among it

  • You may request deletion of your data at any time (see Section 10.2)

  • We may retain certain information after account deletion as required by law or for legitimate business purposes

8. How We Share Your Information

We do not sell your personal information. We may share your information only in the following circumstances:

8.1 Service Providers

We may share information with third-party service providers who perform services on our behalf:

  • Cloud hosting and database providers, for running the Service and storing your data

  • Stripe, for billing

  • Cal.com, for meeting scheduling

  • Anthropic, which processes your AI coaching conversations

  • Resend, which delivers the emails we send you

We do not use analytics services, advertising networks, or third-party customer support tools.

These service providers are contractually obligated to protect your information and use it only for the purposes we specify.

8.2 Third-Party Services

LinkedIn:

Stripe:

  • Payment information is handled by Stripe

  • Stripe’s Privacy Policy: https://stripe.com/privacy

  • We do not store your payment card information

Cal.com:

  • Meeting scheduling is handled through Cal.com

  • Cal.com’s Privacy Policy: https://cal.com/privacy

  • Your name, email address, and any notes you add to a booking are shared with Cal.com to enable scheduling functionality

Anthropic:

  • AI coaching sessions are processed by Anthropic’s Claude models

  • What is sent: your first name, the career goal you have defined, the competencies you have identified, and the messages you write during the session

  • Anthropic’s Privacy Policy: https://www.anthropic.com/legal/privacy

  • We access Anthropic through its commercial API, under which Anthropic does not use the content of these conversations to train its models

  • We are not responsible for Anthropic’s services, availability, or data practices

Resend:

8.3 Legal Requirements

We may disclose your information if required by law or in response to:

  • Valid legal process (subpoenas, court orders, etc.)

  • Government requests

  • Law enforcement requests

  • To protect our rights, property, or safety, or that of our users

8.4 Business Transfers

If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership.

8.5 With Your Consent

We may share your information with your explicit consent for purposes not described in these Terms.

9. Data Security

9.1 Security Measures

We implement reasonable security measures to protect your information:

  • Encryption in transit (HTTPS/TLS for all data transmission)

  • Secure authentication token storage

  • Access controls and authentication requirements

  • Regular security assessments

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. You use the Service at your own risk.

9.2 Your Responsibility

  • You are responsible for maintaining the security of your account

  • You must notify us immediately of any unauthorized use of your account

  • You are responsible for the accuracy of the information you provide

9.3 Data Breach Notification

  • In the event of a data breach that affects your personal information, we will contact all affected users as soon as reasonably possible

  • We will provide information about the nature of the breach and steps you can take to protect yourself

10. Your Rights and Choices

10.1 Access and Correction

You have the right to:

  • Access the personal information we hold about you

  • Correct inaccurate or incomplete information

  • Request a copy of your data

To exercise these rights, contact us using the information in Section 19.

10.2 Data Deletion

You may request deletion of your account and associated data at any time:

  • Contact us using the information in Section 19

  • We will delete your data within 30 days of your request

  • Some data may be retained as required by law or for legitimate business purposes

  • Canceling your subscription does not automatically delete your account or data

  • Deletion covers the data described in Section 7.1, including your goal, competencies, AI session records, meeting history, and email history

10.3 Opt-Out Options

  • You may cancel your subscription at any time

  • You may request to opt out of certain data collection (though this may limit Service functionality)

  • You can control cookies through your browser settings

10.4 Data Export

The data we hold about you is described in Section 7.1. There is currently no automated data export functionality. If you need a copy of your data, please contact us.

10.5 California Privacy Rights (if applicable)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to know what personal information we collect, use, and disclose

  • Right to delete your personal information

  • Right to opt out of the sale of personal information (we do not sell personal information)

  • Right to non-discrimination for exercising your privacy rights

11. User Responsibilities and Acceptable Use

11.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service to violate any applicable laws or regulations

  • Use the Service to infringe on intellectual property rights

  • Attempt to reverse engineer, decompile, or disassemble the Service

  • Interfere with or disrupt the Service’s functionality or servers

  • Share your account credentials with others

  • Use the Service to collect data about other users without their consent

  • Use the Service in any way that could damage, disable, or impair our services

  • Use automated tools or scripts to access the Service beyond normal usage

11.2 Compliance with LinkedIn Terms

  • You must comply with LinkedIn’s Terms of Service and User Agreement

  • We are not responsible if your LinkedIn account is restricted or terminated

11.3 Accuracy of Information

  • You are responsible for the accuracy of the information you provide

  • You are responsible for maintaining the security of your account

  • You must notify us immediately of any unauthorized use of your account

11.4 Account Sharing

  • Your subscription is for your personal use only

  • You may not share your account with others

  • Violation of this policy may result in account termination

12. Intellectual Property Rights

12.1 Our Rights

  • The Service, including its code, design, logos, and content, is owned by Mindspire LLC

  • All rights, title, and interest in the Service remain with Mindspire LLC

  • The Service is protected by copyright, trademark, and other intellectual property laws

12.2 Your Rights

  • You retain ownership of any data you create or upload through the Service

  • You grant us a license to store, process, and display your data as necessary to provide the Service

  • You may request deletion of your data at any time (see Section 10)

12.3 Third-Party Content

  • Content from third-party services (LinkedIn, Cal.com, etc.) remains the property of those services

  • We do not claim ownership of third-party content

  • Your use of third-party content is subject to those services’ terms

13. Service Availability and Modifications

13.1 Service Availability

  • We strive to maintain service availability, but do not guarantee uninterrupted access

  • The Service may be unavailable due to maintenance, updates, or technical issues

  • We are not liable for any loss or damage resulting from service unavailability

13.2 Modifications to Service

  • We reserve the right to modify, suspend, or discontinue the Service at any time

  • We may update the Service to add features, fix bugs, or improve security

  • Updates may change functionality

  • We are not obligated to provide notice of all changes

13.3 Coach Availability and Assignment

  • Coaches set their own schedules and availability

  • Coach availability is subject to their schedules and capacity

  • We do not guarantee that a specific coach will be available at all times

  • Coaches are assigned based on availability, but you may request a different coach if you feel your current coach is not a good fit

  • If you feel your coach is not available enough, we encourage you to discuss scheduling with your coach or request assistance finding a coach with better availability

  • If your coach leaves the service and we cannot find a suitable replacement, we will cancel your subscription and provide a full refund for your current billing period

14. Limitation of Liability and Disclaimers

14.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR RELIABILITY OF DATA

  • UNINTERRUPTED OR ERROR-FREE OPERATION

14.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100, WHICHEVER IS GREATER)

  • WE ARE NOT RESPONSIBLE FOR:

    • LOSS OF DATA OR INFORMATION

    • LOSS OF PROFITS OR BUSINESS OPPORTUNITIES

    • DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE

    • THIRD-PARTY SERVICES (INCLUDING LINKEDIN, STRIPE, CAL.COM)

    • UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA

14.3 Career Outcomes

  • We do not guarantee that you will find employment, receive promotions, or achieve career goals through the use of the Service

  • We are not responsible for job application outcomes or career decisions

  • Career coaches provide guidance and support, but outcomes depend on many factors beyond our control

  • The Service provides coaching and support, not guarantees of specific results

15. Indemnification

You agree to indemnify, defend, and hold harmless Mindspire LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any data or content you submit through the Service

16. Account Termination

16.1 Termination by You

  • You may cancel your subscription at any time through your account settings

  • Canceling your subscription does not automatically delete your account or data

  • You must separately request account deletion if you want your data removed (see Section 10.2)

16.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms

  • You engage in fraudulent, illegal, or harmful activities

  • You fail to pay the required subscription fees

  • We discontinue the Service

  • For any other reason we deem necessary to protect our services or users

Upon termination:

  • Your access to the Service will be revoked

  • We may delete your account and data

  • You will not be entitled to any refund for the current billing period

Coach Leaving: If your assigned coach leaves the service and we cannot find a suitable replacement coach, we will cancel your subscription and provide a full refund for your current billing period.

17. Changes to Terms

17.1 Modification Rights

We reserve the right to modify these Terms at any time. We will:

  • Update the “Last Updated” date at the top of these Terms

  • Provide notice of material changes through the Service or via email

  • Post updated Terms on our website

17.2 Acceptance of Changes

  • Continued use of the Service after changes constitutes acceptance of the modified Terms

  • If you do not agree to the modified Terms, you must cancel your subscription and stop using the Service

  • Material changes will be effective 30 days after notice (or immediately for security-related changes)

18. Dispute Resolution and Governing Law

18.1 Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

18.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved in the state and federal courts located in Ohio, and you consent to the jurisdiction of such courts.

18.3 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 60 days.

We will respond to your inquiry within 30 days.

20. Additional Provisions

20.1 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

20.2 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

20.3 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.

20.4 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20.5 Entire Agreement

These Terms constitute the entire agreement between you and Mindspire LLC regarding the Service and supersede all prior agreements and understandings.
